These Terms of Use apply to Sparky, the iPhone app, and to this website. By downloading, accessing, or using Sparky, you agree to these Terms. If you do not agree, please do not use Sparky.

Relationship to Apple's Standard License Agreement

Sparky is distributed through Apple's App Store and is licensed to you under Apple's Licensed Application End User License Agreement ("Apple's Standard EULA"), unless a different license agreement has been registered with Apple. These Terms of Use supplement Apple's Standard EULA and cover matters specific to Sparky, such as the habit and Energy system and subscriptions. Where these Terms conflict with Apple's Standard EULA on licensing matters, Apple's Standard EULA governs.

Using Sparky

Sparky lets you set up habits, earn Energy by completing them, and use that Energy to open apps you have chosen to gate through Apple's Screen Time and Family Controls frameworks. You are responsible for the habits, gates, and settings you configure, and for how you use the app.

Sparky is a personal productivity and habit tool. It is not medical, psychological, or professional advice, and it is not a treatment for any condition. If you have concerns about screen use, attention, or your mental health, consult a qualified professional.

Eligibility

Sparky is intended for users who meet the minimum age required by the App Store in their country. If you are using Sparky on a device managed by a parent or guardian through Family Sharing or Screen Time, that parent or guardian is responsible for reviewing these Terms and the Privacy Policy.

Your Content

The habits and settings you create are yours. You are responsible for how you use the app and for keeping your device secure.

Subscriptions and Purchases

Sparky Pro is available as a monthly subscription ($8.99/month) or a yearly subscription ($59.99/year, with a 3-day free trial on the yearly plan only). Subscriptions are billed by Apple through the App Store and renew automatically unless canceled at least 24 hours before the end of the current period. You can cancel any time in your iPhone's Settings, under your Apple ID; canceling keeps Pro access until the current period ends. If you do not cancel before the trial ends, the yearly plan renews at the price shown at purchase.

No Warranty

To the maximum extent permitted by law, Sparky is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not warrant that Sparky will be uninterrupted, error-free, or that it will gate any particular app at any particular time, since Sparky relies on Apple's Screen Time and Family Controls frameworks, which are outside my control.

Limitation of Liability

To the maximum extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of or inability to use Sparky, even if advised of the possibility of such damages. My total liability to you for all claims related to Sparky will not exceed the greater of fifty dollars ($50) or the amount you paid me in the twelve months before the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.

External Services and Apple Frameworks

Sparky depends on Apple's Screen Time, Family Controls, and StoreKit frameworks to function. I am not responsible for changes Apple makes to these frameworks, or for their availability, accuracy, or performance.

Termination

These Terms remain in effect until you stop using Sparky or delete the app. I may suspend or discontinue Sparky at any time.

Governing Law

These supplemental Terms follow the same governing law as Apple's Standard EULA: the laws of the State of California for users in the United States, or the laws of your usual place of residence if you are a citizen of a European Union country, Switzerland, Norway, or Iceland.

Changes

I may update these Terms as the app grows. Continued use after an update means you accept the new Terms.
